Terms of Service

1. Acceptance of Terms

By accessing or using Flip My Performance ("FlipMP", "the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not access or use the Service. These Terms form a binding legal agreement between you and Flip My Performance.

2. Description of Service

FlipMP is a web-based multisport fitness coaching platform that aggregates training data from third-party applications and provides AI-powered coaching insights, performance analytics, and training planning tools. The Service is currently in beta and available free of charge. We reserve the right to introduce paid tiers in the future with reasonable advance notice.

3. User Accounts

You must provide accurate, complete, and current information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must be at least 16 years old to use the Service. Notify us immediately at hello@flipmp.com if you suspect unauthorised access to your account.

4. Acceptable Use

You agree not to: (a) use the Service for any illegal purpose or in violation of applicable law; (b) attempt to reverse engineer, decompile, or circumvent the security measures of the Service; (c) use the Service to harass, harm, or defraud any person; (d) use automated tools to scrape, crawl, or extract data from the Service without authorisation; (e) upload or transmit malware, viruses, or any malicious code; (f) impersonate any person or entity or misrepresent your affiliation.

5. Third-Party Integrations

The Service integrates with third-party platforms including Strava, Garmin Connect, Apple Health, Google Fit, Polar Flow, Wahoo, and Zwift, among others. Your use of these integrations is subject to those platforms' respective terms of service and privacy policies. We are not responsible for the availability, accuracy, or terms of third-party platforms. Connecting a third-party account authorises FlipMP to read your fitness data from that platform on your behalf.

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. You retain ownership of all personal data and fitness data you provide or sync to the Service. By using the Service, you grant FlipMP a limited, non-exclusive licence to process your data solely to provide the Service features. You can delete your account and data at any time.

7. Intellectual Property

The Service, including its design, code, AI models, brand assets, and content (excluding your personal data), is the intellectual property of Flip My Performance. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our prior written consent. Your feedback or suggestions about the Service may be used by us without obligation to you.

8. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. FITNESS, TRAINING, AND HEALTH INFORMATION PROVIDED BY THE AI COACH IS FOR INFORMATIONAL PURPOSES ONLY AND DOES NOT CONSTITUTE MEDICAL ADVICE. ALWAYS CONSULT A QUALIFIED HEALTHCARE PROFESSIONAL BEFORE STARTING OR CHANGING AN EXERCISE PROGRAMME. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FLIPMP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

9. Beta Service Disclaimer

FlipMP is currently in beta. The Service may contain bugs, errors, or incomplete features. Features may be changed, added, or removed without notice. We do not guarantee uptime, availability, or data persistence during the beta period. We will make reasonable efforts to preserve your data but recommend maintaining your own backups with connected fitness platforms.

10. Changes to Terms

We may update these Terms from time to time. We will provide at least 14 days' notice of material changes via email or in-app notification before they take effect. Continued use of the Service after the effective date of changes constitutes your acceptance of the updated Terms. If you do not accept the updated Terms, you must stop using the Service.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of Portugal and applicable European Union law. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Portugal, unless mandatory consumer protection laws in your jurisdiction provide otherwise.
